Complaint Details
I purchased in Pune. I booked the flat in Subh Ganesh Spring Valley Phase 2 project (P52100013807) in July 2018, the registration agreement of the said property was done in March 2019. My home loan sanctioned by SBI and partly disbursed in installments. I am paying Pre-EMI on my home loan since April 2019. As per the agreement copy the committed possession date for this flat is 31 Dec 2019. However, the possession is still not given and I am not clear when the actual possession will be given. After multiple follow up with builder and his sales team I am still not getting any update on the final possession date, which is quite annoying. If there is any delay due to any reason the builder and promoter must proactively convey it in writing to us, which is not yet done, moreover there is no any communication by the builder in this context. When asked about the details and relevant compensation in terms of monthly rent or interest on money paid due to delay, there is no response from the builder and the sales team. I am paying heavy pre-EMI on the loan borrowed from SBI further to this them monthly rental, totaling the amount to 40K per month which more than 55% of my monthly income. It is becoming very difficult to service the loan and run the household expenses in this high inflation period and pandemic situation! With this complaint I want the NCH team to address my concerns and provide justice with the following as per the prevailing law/ act, whichever is applicable under the sight of learned authority/ tribunal: 1. Order the Builder to provide confirmation on the final possession date and handover of the said property immediately. 2. Order the Builder to give Monetary Compensation for the period of delay along with interest starting from 01 January 2020 till the date of actual possession. 3. Order builder to provide the final confirmation date of the project for all the committed amenities as per the master plan shared during the booking. 4. Guide me for appropriate steps to be taken in order to get justice. Appreciate your prompt response and a necessary quick action in this context. Awaiting your prompt response. Thank you.
