Re: Tata Walky & Tata Photon Plus having CAF 04323905 and 04323906

On the 10th of January 2012, I had purchased a Tata Walky ESN HEX 4654FAEE and the number allotted was 22-65615284 along with a Photon Plus MEID: A0000033468917 having number 9223134837 and Account No: 980614930 vide cheque nos. 400505 for Rs. 1299/- and 400506 for Rs. 1199/- drawn on HDFC Bank Ltd. respectively from Sky Net Telecom (Authorised Distributors) Shop No. 19, Ghanshyam Tower. M.G.Road, Next to Charwak Hotel, Borivli (East), Mumbai 400066 represented by Mr. Sagan Derra (Mob. 9833093348) who visited me at my residence.
Sagan Derra convinced me that the Photon Plus that he was giving was a corporate version which was only given to 12 select people in this area and was faster than the Photon that I was using at present and also convinced me that if I purchased the Photon Plus then the Walky was provided free of cost but I had to only pay the TRAI charges.
I had handed over Xerox copies of my PAN Card, Driving licence and Senior Citizen Card along with the Customer Application Forms (CAF 04323905 and 04323906 respectively) to Mr. Sagan Derra on 10th of January 2012. On 18th of January 2012, I received the Walky and the Photon Plus from Sky Net Telecom vide Bill No. 11/102421 (Xerox copy attached). Kindly check the CAFs columns 17 & 18 which show the documents I have handed over for proof of identity and proof of address. I would like to know how both these instruments were activated at your end if you had not received my Documents as on the 30th of January, I received an SMS on the Walky saying your address could not be verified and the Walky as well as the Photon Plus were deactivated immediately. When I complained to the Customer care no. +91-9220000121 that the Walky was not functioning I was told that an Engineer would be sent to verify the problem and I would have to bear the charges of Rs. 100/- which I refused. I lodged a complaint on 31/1/12 and 1/2/12 complaint nos 419913 and 420338 respectively. I received a mail saying I would be contacted in 6 business hours and a solution would be provided which has not happened. On 1/2/12 I spoke to Mr. Subramaniam (+91-9220000121) who said he would get back to me but that too has not happened. After that I contacted Mr. Vishnu Purohit from Sky Net Telecom thrice who would just disconnect the call. Next I spoke to Ms. Smita from Sky Net Telecom and informed her that under these circumstances where a Customer has not been provided service despite paying for the same I am compelled to return both the Walky and the Photon Plus and seek a full refund for deficiency in service.
On the 8th of February2012, I had a telephonic conversation with Mr. Suhas from the Nodal Officer Ms. Sugan Shetty’s office and then subsequently a conversation with Ms. Anjali from the Appellate Office on 9th February 2012 at 10.45 am. It was decided by Ms. Anjali that I would deposit the Tata Photon Plus EC 156 having MEID: A0000033468917 pESN:804750EF S/N:A4G4CA11C1931336 and the Tata Walky Model:Delta Prime SAP:10014206 S/N:UC9B1003061 ESN HEX:4654FAEE after she sends me an e-mail specifying the Tata Docomo outlet where I could deposit the above mentioned instruments and get an acknowledgement after which I would be fully reimbursed that is Rs. 2498.00 (Rupees Two Thousand Four Hundred and Ninety Eight Only). I received an e-mail on 11th February 2012 from Ms. Sarala Kharche (Nodal Desk- Tata Docomo) in this regard with the subject: Service disconnected of Tata Walky & Tata Photon Plus –M6623911. I returned both the above mentioned instruments as instructed to the Malad TVH Shop No.5,5A,6,6A, Ground floor, Ajanta Shopping Centre, A Wing, Daftary Road, Malad (E), Mumbai (MHB014) on 14.02.2012 and got an acknowledgement from Ms. Rukhsar Memon Sales Advisor with request nos. for the Walky as 702615303 and for the Photon Plus as 702615212 on the copy of the covering letter where I had mentioned that both these instruments have been received by you in the condition that they were delivered to me on 18th January 2012 and to initiate the process of reimbursement as soon as possible. I emailed this acknowledgement on 14.02.2012.
On the 18th and 21st of February, I received an e-mails from Sarala Kharche Nodal Desk- Tata DOCOMO informing me that with reference to your email, we have taken up the case on your behalf and our concern team is working on the same. We shall get back to you on top priority with the proceeding. We appreciate your patience and extended cooperation.
I am yet to receive a reply from Tata DOCOMO regarding my refund.
