Complaint Details
I had booked a flat at nalasopara after viewing the advertisement in local news paper in 2009 I had paid builder amount of Rs.136000/- the pasetion was to be given in March 2010 since than the Office bearer of builders is not available I tried to contact on phone but they are not attending my phones, to my surprise the building construction is still not completed now they builder is asking for additional amount Please suggest how should I & other members who had booked the flat should go about.

Reply: Dear Mr. Sunil,

This has reference to your complaint against Vishwakarma Construction. Your complaint was forwarded to our legal cell and their comments are as follows-

"The Complainant must file a consumer Complaint and also seek interim relief u/s 13(3-B) so that no third party interest can be created by the builder in the said flat. The complaint needs to filed with the Consuemr forum as per the address of the builder or at Thane District Forum. In case Vishwakarma constructio is a partnership firm make all the partners also a party and in case it is proprietory firm then make the proprietor a party too. The earlier you file the complaint the better."
