THE COMPLAINANT SUBMITS AS HEREUNDER:

1. That I am the Complainant, a resident of the abovementioned addressed.
2. I had purchased a washing machine WM-HDS-1260TVEME from Opposite Party No. 2 from his authorized trader, the Opposite Party no. 1, on 10.09.2007, at Dehra Dun , invoice number 7040640.
3. That the aforesaid washing machine due to some malfunction/defect stopped working in the month of June 2013.
4. That the Complainant registered a complaint with opposite party number 1 and number 2 on the 21st of June, 2013, which was registered as complaint number 1306210024. However no action was taken by the Opposite Parties for more than a months , a person named Manoj claiming to be the Official Technician, visited Complainant’s residence and falsely assured and promised that the part of the washing machine which has malfunction/turned defective i.e the P.C.B, shall soon be replace by the Opposite Party within few weeks as they were expecting the arrival of some new consignment in which the aforesaid P.C.B. shall arrive.

That despite of the promises and false assurances by the Opposite Parties 1 and 2, no such spare part, i.e. P.C.B or whatsoever., was ever made available to the Complainant within the stipulated time period. After several telephone call and visits to the outlet of the Opposite Party No. 1 by the Complainant, Mr. Manoj was again send on 29th, July 2013, who this time uninstalled and took the P.C.B. and promised and assured the Complainant that the malfunctioning/defective part of the machine shall be repaired and rectified within 2 weeks time maximum and regretted for the lack of service and delay as well, Also I paid Rs. 350/- as Mr. Manoj’s visiting charge, Since then till date the technician has never ressponed to my calls nor has answered to the issues seriously and have taken iit very casually, on my personal visits to there service centers, i was told that they are trying to arrange all these fake promises and delays have been continuing since the time PBC was uninstalled from my machine, Therefore my machine has been of no use since then till date and the PBC is missing getting alternate help from local service vendor, furthermore on my demand of the product the Officials have been misbehaving, Its hard to believe that the part is in transit,Since July 2013? On my recent attempts since past few months i have been ignored and finally the service center people have decided to say the complaint is closed as the model is absolute .

6. It is further submitted that in the year 2007 I had invested a good sum of money, Rs. 20500/-, for the said washing machine. It was claimed by the Opposite Party No.2 that the washing machine was a premium product and best among other similar products in the market. It was further promised that after sale service will be taken care of by the Opposite Party No. 2 or their registered agents. Relying on these promises I had bought the washing machine.

It is also submitted that the defect in the product, deficiency in service and reckless attitude of the service providers has caused a great deal of hardship and mentally agony to me and my family for more aforesaid period . The said washing machine was bought to provide some comfort to my wife, who is not keeping well, but great deal of hardship was caused due to malfunctioning of the machine and lack of service and false promises, ignorance made by the company for more that years . To add to these hardships both Opposite Party 1 and 2 have failed to provide the service that they were duty bound to provide. It is further submitted that since the winters are setting in the above mentioned problems and hardships will only enhance causing more inconvenience and health problems.Therefore i have finally decided to seek help from the consumer forum.
