Hi, my name is krishnan 40 years old staying in Thane. Really sorry for the long message. I planned to buy a flat near thane, mumbai. I met a real estate agent shivakannan(from mahaveer homes present in thulasidaam, thane) and he recommended a flat in kasheli(near toll naka) which is close to thane. The builder name is Delip mishra(staying in lokamanya nagar, thane) and Raju mishra. they were selling the flats in the name of Royal enterprices. The cost of the flat was 13lakhs during 2012. The developer showed me the development aggrements and other documents. he told me that he got all permission to construct the building. it was mentioned in the aggrement that the development of the building will be done after getting all the necessary permissions. I believed my agent and the builder. I started paying monthly installments to the builder and days passed by. The building was almost completed and I had paid upto 10.6 lakhs to the builder. I insisted the builder to register the flat on my name. The builder was not ready to register. On 1st January 2014 the thahasildar of kasheli/bhiwandi gave order to demolish the building and it was demolished to a good extent. I came to know that the building was constructed without getting any permissions. I tried my best to get my money back. builder gave two cheques to me. the first cheque worth one lakhe got honoured in the bank. the second cheque worth 9.6lakhs bounced back and I got to know that builder have informed the bank to stop the payment. When I spoke to the builder on it, builder arranged a goonda to make sure I won't go to police or court. The residence address of the builder and the office address given in documents were fake. I had to search for the builders residence in lokamanya nagar in thane. I tried to give NC (non cognigible offence) in the name of the goonda and the builders. but varthak nagar police told me a unwritten rule that you can file only one NC in a day. Then I filed FIR in Narpoli police station against builder. the police was reluctant in filing the Fir. finally the FIR was filled during September 2014. I met the police officer and gave all the proofs I had. I keep contacting the police officer once in two weeks. I gave complain letter to all the police commisinor in Thane and Bhiwandi when there was no action taken for 5 months. but till today (FIR was filled 7 months before)there is no action taken on the builder. The builder might have given money to police. the Fir number is I423/14 filed on 26/09/2014 Narpoli police station. Many good hearted people might be reading this message.
