Complaint Details
I Mr. Rambali R. Maurya gave a cheque of Rs.50, 000 (cheque no.100017, Abhyudaya Co-op Bank Ltd.) as a token money for a purchase of a flat no. 401, B wing, fourth floor, 1 room kitchen having area 425 sq. ft. in Saraswati Apt., near Rahul International School, Patankar Park, Nallasopara (w), Taluka-Vasai, Dist.-Palghar-401203 to the opponents mentioned above. Then I enquired regarding the documents of the said property by using RTI to vasai –virar mahanagarpalika. Then I understood that documents provided by the opponents are forged.
Then I immediately approach to the opponents regarding the forged documents and fraud, they have no answer on that, hence I asked for the refund of money paid of (Rs.50, 000), after a regular follow up done by me to the opponents office he gave me a cheque of Rs. 50,000 dated 3/4/2014 of Kotak Mahindra Bank (cheque no. 000281). That cheque was dishonored on 4/4/2014 due to insufficient balance. When I approached him about cheque dishonor he gave me excuses and asked me to deposit again that same cheque, I deposited that cheque again and it was also dishonored on 17/04/2014 due to insufficient funds. After that I tried to meet the opponent many time personally and on phone but I got no positive response from him. He assured me that within a day or two I will return your money. He kept on giving the regular assurance for the repayment of money, but till date he has not paid the amount. Further I approach Adovcate Mrs. Reena S. Rodrigues for legal proceedings. Then notice was sent on 27/11/2014 to the opponents regarding the fraud and cheque dishonor done by the opponent, so that I can have the proof for filing the case at the consumer court. I was mentally frustrated and it was harassment to me by the opponents.
